The National Multifamily Housing Council released a new white paper that examines the state of play in the rapidly evolving data protection and privacy regulatory landscape. It identifies 14 specific steps firms should take to prepare for existing and forthcoming legislation.
Following on the heels of Europe’s landmark data privacy and protection law (GDPR), California passed the U.S.’s most rigorous data privacy law to date, the California Consumer Protection Act (CCPA). CCPA gives consumers vastly more control over how their personal information is collected, used and how that data must be protected. It is set to take effect January 1, 2020, and other states are looking to enact similar consumer protections.
The number of firms required to comply with the CCPA has expanded to businesses across the country because the law requires any covered firm that interacts with a California consumer to comply—even if the firm does not have a physical location in the state. The extraterritorial reach of the California law and the increase in legislative action, including at the federal level, makes it important for firms to understand their potential compliance obligations and how those might change based on the common themes currently being discussed.
“Historic data breaches, such as Equifax and Facebook, are leading policymakers at all levels of government to enact wide-ranging data privacy and protection laws that fundamentally change the framework for how data is regulated in the U.S.,” said Kevin Donnelly, NMHC’s Vice President of Government Affairs.
“As apartment firms and their supplier partners evaluate the ever-evolving data privacy legal landscape, they can prepare by proactively accounting for data privacy and security considerations in business operations,” said Julianne Goodfellow, NMHC’s Senior Director of Government Affairs.
NMHC’s white paper, authored by Manatt, Phelps and Phillips, LLP, seeks to help apartment owners develop their strategies for addressing data privacy and protection.
